Welcome to Zurri Bluu Holiday Home. The website located at https://www.zurribluu.co.za/ (the "Website") and the boutique holiday home property situated at 1468 Hibiscus Street, Wilderness, South Africa are owned and operated by Atlas Software ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our Website, any bookings made with us, and your stay at Zurri Bluu. By making a booking or staying at our property, you agree to be bound by these Terms.
1. Bookings and Payments
1.1. Booking Confirmation: A booking is only secured once we receive the required booking deposit (50% of the total accommodation fee) and we issue a written confirmation email.
1.2. Balance Payment: The remaining balance of the booking fee must be paid at least 30 days prior to your scheduled check-in date. If the booking is made less than 30 days before arrival, the full booking amount is payable immediately.
1.3. Payment Methods: We accept secure payments via credit card, instant EFT, or other online payment gateways listed on our Website.
1.4. Rates: Room rates are quoted in South African Rand (ZAR). Rates are subject to change without notice; however, the rate confirmed at the time of your booking will be honored.
2. Cancellation and Refund Policy
2.1. All cancellations must be requested in writing via email to info@zurribluu.co.za.
2.2. Cancellation Fees: The following fees apply based on the date we receive your cancellation notice:
- Cancellation 60 days or more prior to arrival: Full refund of the deposit, minus a 5% administration fee.
- Cancellation between 30 and 59 days prior to arrival: We will retain 50% of the total booking value.
- Cancellation less than 30 days prior to arrival: We will retain 100% of the total booking value (no refund).
2.3. No-Shows & Early Departures: If you fail to arrive for your booking (no-show) or decide to shorten your stay after check-in, no refund or credit will be provided.
3. Security and Breakage Deposit
3.1. A refundable security/breakage deposit of R3,000 is payable prior to check-in.
3.2. We will inspect the holiday home within 3 to 7 business days after your departure. If the property is left in the same condition as arrival, with no breakages, damage, missing items, or violations of the house rules, the deposit will be refunded in full to your bank account.
3.3. In the event of damage or loss, the cost of repairs, replacement, or specialized deep cleaning will be deducted from this deposit. If the cost of damages exceeds the security deposit, you will be liable for the outstanding balance.
4. Check-In and Check-Out
4.1. Check-In Time: From 14:00 to 18:00. Early check-ins must be requested in advance and are subject to availability.
4.2. Check-Out Time: By 10:00. Late check-outs may incur a penalty fee unless pre-arranged and confirmed in writing.
4.3. Identification: Guests must present a valid ID, passport, or driver's license upon arrival.
5. House Rules and Guest Conduct
To ensure a pleasant stay for everyone and to respect our neighbors, guests must adhere to the following rules:
- Maximum Occupancy: The property sleeps a maximum of 10 guests (5 bedrooms, 4 bathrooms). No additional overnight visitors are allowed unless pre-authorized in writing.
- Noise and Events: Parties, events, or excessive noise are strictly prohibited. Loud music or disruptive noise is not allowed after 22:00 in compliance with local municipal bylaws.
- Smoking: Smoking (including e-cigarettes/vapes) is strictly prohibited inside the holiday home. Smoking is only permitted outdoors on the deck, and all cigarette butts must be disposed of safely.
- Pets: Pets are not allowed on the property unless prior written exception and consent have been provided.
- Plunge Pool Safety: Use of the plunge pool is at your own risk. Children must be supervised by an adult at all times near the pool and deck area.
6. Limitation of Liability and Indemnity
6.1. By booking and staying at Zurri Bluu, you and all members of your party agree that you enter the property and use the facilities (including the plunge pool, deck, and beach access) entirely at your own risk.
6.2. Neither the owners, hosts, staff, nor agents of Zurri Bluu shall be held liable for any loss, theft, damage to personal property, personal injury, illness, or death suffered by any guest during their stay, howsoever caused.
6.3. You agree to indemnify and hold harmless the owners, hosts, and staff against any claims, losses, or expenses arising from your stay or conduct on the property.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these terms or your booking shall be subject to the jurisdiction of the South African courts.
